ESB Court Papers...

At my advanced age, reading 62 pages of legal text has a low priority relative to... say... a Hans Christian Andersen tale. That said, I did skim the pages sufficiently close to sense serious trouble ahead. It does not paint the future Reimers mumbles about.
Is this what I said over a year ago would happen and they want their money and will sue to get it? I also said there were no rent negotiations and IF there were any negotiations it was Reimers trying not to get WBAI sued and evicted.
Basically, I agreed with that assessment, but I think we view Reimers' motive from slightly different angles.
Yes, he was probably trying to avoid a lawsuit and eviction, but not out of concern for WBAI's welfare—he was trying to save his own ass, knowing full well that his own ineptitude and neglect played a major part in an irreversible path to the edge of the cliff.
A report is circulating that The California Attorney General's Office had a sit down with the Pacifica Officers. Reportedly restricted funds misuse, poor management and financial management, intolerable National Board Meetings, and no-premium premiums were discussed. More info? Hint: Look under the carpet for the sweepings.
I have a couple of related and interesting legal docs ...
Looks like Pacifica is being represented in this case by none other than Himmelstein, McConnell, Gribben, Donoghue & Joseph LLP (http://pacificainexile.org/archives/559). And they want to extend the time to answer to February 6 ...

I am happy that the California Attorney General read my lettersI delineated many of the fraudulent activities of Berthold Reimers and R Paul Martin.
The irony is that R Paul Martin openly taunted me to write to the federal government. Martin quoted Carolyn Birden's taunt that my letters "will get the attention they deserve." my letters did.
As for the lies published by the Federal Communications Commission, I requested the name of the Congressional Committee, which oversees the FCC. That is why the FCC renewed the license.
Berthold Reimers and R Paul Martin lied to everyone.
To demonstrate the stupidity, or should I say autistic reality of one individual: When I stated that Berthold had lied about the phone lines to the Corporation for Public Broadcasting, the autistic individual stated that it should not matter if Berthold lied. He further inquired as to why should the individual be angry if Berthold lied.
Incidentally, Trump wants the Corporation for Public Broadcasting to be privatized. That does not bode well for WBAI- and Pacifica.
VERY easy solution: Approach Cumulus and do a swap for their 94.7 WNSH Newark plus some cash and assumption of the debt owed to the Empire State Building. Cumulus then gets a better facility at 99.5 which becomes WNSH, and WBAI goes to 94.7 which is still a very good New York City signal, debt free, with a bit of cash.

DeleteThe next two pages are formal summons, and require no more than a glance.
The following pages, numbered one through seven, are the actual filing, which seeks judgement.

Maybe even simpler. You don't just let $110,000/year slip out of your hands. He'll never get a salary like that again anywhere.

ReplyDeleteBad idea. All the majors are carrying crushing debt loads. Just read the trades like Variety, Talkers, WSJ and NYT.
