Pacifica in Exile's May Day message...



LEGAL BILLS FOR PROCEDURAL QUIBBLES

Berkeley-In bicoastal court appearances this week, Pacifica relied on procedural feints to further delay hearings on two requests for injunctive relief filed against them by their own members. In Northern California, Yeakey vs. Pacifica requests the removal of 7 national board members whose elected terms expired in December of 2015 and who were not re-elected, and the removal of two Pacifica affiliate representatives who are not affiliated with current Pacifica affiliated stations. The complaint can be seen here. In New York, Young vs Pacifica requests the seating of national board representatives from WBAI-FM who have been prevented from voting or participating on the national board for four months by the Siegel/Brazon majority faction. In California on April 26th, Siegel and Yee attorney Alan Yee appeared for Pacifica and LA attorney Jerry Manpearl for plaintiffs Lamont Yeakey and Chandra Hauptman. Pacifica has requested the two members post a $50,000 bond, but as Manpearl pointed out, no such bond is required for an elections-based lawsuit by members. The next hearing has been set for May 5th at 2:30pm in Department 16 of Alameda Superior Court in the Administration Building at 1221 Oak Street.

In New York on April 29th, Jesse Siegel, a New York criminal defense attorney and unofficial corporate counsel Dan Siegel's brother, appeared for Pacifica and also angled for delays, including questioning the location of the case in New York. Previous election-related cases at WBAI have been decided in New York, including the 2007-2008 Cohen vs. Pacifica case, which Pacifica lost after running up tens of thousands in legal bills on similiar procedural delays. Attorney Gary Carlton represented plaintiffs Bob Young and Stephen Brown. The next hearing has been set for May 13th in Kings County Supreme Court at 360 Adams Street in Brooklyn, NY.

The Siegel and Yee procedural filings are running up Pacifica's costs by generating multiple hearings and more paperwork while avoiding substantive discussion on the merits of the complaints. The Pacifica National Board has not met in closed session with their attorneys even once and have not authorized or been apprised of what is being filed in their name or the costs they are generating for the foundation with procedural objections. Independent board members Grace Aaron, Jan Goodman, Bill Crosier and Jonathan Alexander have been persistent in their requests to the board majority to resolve the lawsuits by ending bylaws violations and not squander foundation resources fighting the lawsuits which request no damages or restitution from Pacifica besides correcting the board of directors roster so it has WBAI representation and all directors are elected.

At Wednesday's national board coordinating committee meeting, board officers commanded a "special order of business" to correct the national office budget  that didn't allocate a penny for an election supervisor salary in 2016. They described the error as an omission that needed to be urgently corrected due to the Yeakey vs. Pacifica lawsuit. They did not address multiple notifications received by both the national finance committee and the national board itself that the salary allocation was missing, including one sent days before the national board vote. Pacifica still has no agency budget for the year, having only prepared divisional budgets for the California and Texas stations and none for the East Coast stations they are planning to restructure, sell or shut down.

An income statement was released for the period ending 3-31-2016, halfway through the 2016 fiscal year which ends on September 30. As expected, Pacifica began the annual slide into negative numbers as the more lucrative fundraising period runs from September to February in the first part of the fiscal year. All of the Pacifica stations showed an operating deficit for the year to date but LA station KPFK. It's likely the six figure LA surplus is more the product of poor accounting than of an actual operating surplus, given GM Radford's appeal to the national board for permission to solicit an $80,000 loan to purchase and send out back ordered premium gifts to subscribers. KPFK management also requested permission to kick over April network service payments into May due to lack of funds to pay them, and the station recently announced plans to spend no less than half of the 120 days between May 1 and August 30 in 24 hour on-air fund drive. You can view the income statement here (formatting slightly modified from the original to ease readibility).

KPFK attempted to kick off their period of too much fundraising with an email appeal for donations, but the solicitation sent on April 29th, which you can see a copy of here, contained nine different broken links referring back to the screwed up KPFK website, all of which returned page not found errors, including the yellow "donate" button, the solicitations for used car donations and used cell phone donations and the quick links to "listen live", the program calender, the program guide, the membership benefits card and a "more about us" page.

Some LA listeners also expressed frustration when KPFK's controversial volunteer coordinator Adam Rice abruptly knocked award-winning Sri-Lankan author Nayomi Munaweera's interview with Mitch Jeserich on Letters and Politics off the air, wiping out Munaweera in mid-sentence in order to announce the arrest of three protestors at the LA Police Commission that morning. The awkward interruption at 10:52am could have been delayed for five minutes to 10:57am in the interval between programs much more smoothly. Rice is not affiliated with KPFK's news department and the station's news reporters did not participate in the "breaking news alert".

Also in LA, KPFK lost a fundraising program with Ralph's Markets, which allowed members of the station to donate a percentage of their grocery purchases to KPFK. Ralph's (a division of Kroger) ordered the station to end the program and remove all references to Ralph's from the KPFK website in response to charges of anti-semitism from a hard right Zionist group Join The Boycott. GM Radford wrote a long essay on how the Ralph's withdrawal was caused by the station being people-of-color-led and community-based, but apparently didn't look at the JTB group's other targets, which have been fairly mainstream including the Los Angeles Times newspaper, Yahoo, Orange Telecom, Lush Cosmetics, the New York Times, and the California State University at Northridge (CSUN). 

Pacifica appears to have responded to information that fingerprint checks for job candidates not working with children, the elderly or disabled, aren't permitted in California and removed "fingerprint clearance" from the job announcement for a bookkeeper at LA's KPFK. They haven't yet resolved whether the bookeeping job is a full-time or part-time position, describing it under "status" as a regular part-time position and under "definition" as a full-time exempt position in the posted job announcement for prospective candidates to try to decode.

WBAI's operations manager reported that Verizon's Fraud Control Center shut off the NY station's long distance service for a while in response to a call made to the African country of Sierra Leone at 2:45am on Saturday April 23rd. The program on at the time, "Labbrish", conducted a live on-air interview from Sierrra Leone seemingly over the landline telephone. The interview was with Abdulai Bayraytay, a spokesperson for Sierra Leone president Ernest Bai Koroma and can be listened to on WBAI's archives, (it begins at 48 minutes after the hour). Communications with WBAI staff regarding logistics and economical alternatives like Skype, seem not to have occurred.

Whoever filed a mystery lawsuit at WPFW, it was not the previous election supervisor, who has now confirmed twice, once in writing and once verbally, that he did not file a lawsuit, threaten to file a lawsuit or provoke any sort of FCC, CPB or DOJ investigation, despite local station board member Eric Ramey's email of April 21st saying "I I was informed earlier the Corporation for Public Broadcasting is investigating.  In addition the justice department will investigate to determine if any FCC violations have occurred. Accordingly I will invoke the 5th and remain silent". Ramey raised the issue himself at a national elections committee call in April that was Internet-streamed, (you can hear his audio report here), and appears to be invoking the 5th Amendment self-referentially to his own comments. His partial revelation of we're-not-sure-what provoked WPFW PNB member Nancy Sorden to request that he check in with her first before speaking up at streamed meetings.

KPFA's local station board is planning a closed day-long retreat on May 22nd with an unknown agenda and facilitator. It is not known how many board members will attend the retreat, which will not include voting in order to avoid violating Corporation for Public Broadcasting's open meeting requirements. The planned retreat does violate Article 6, Section 7 of the Pacifica Bylaws which specifies that all local board meetings must be open to both members and the general public except those that are closed due to predominant focus on specific matters named as personnel, proprietary trade secrets, negotiations regarding purchases or contracts or advice from a legal counsel. There are no provisions in the Pacifica bylaws allowing closed local board retreats.

The northern and southern wings of the Siegel/Brazon majority faction appear to be butting heads about the spanish language programming mandate passed by the Pacifica National Board in June of 2015. Although KPFA's entire national board delegation including Save KPFA reps Margy Wilkinson, Brian Edwards-Tiekert and Jose Luis Fuentes voted for the addition of 5 hours in spanish between 6am and 6pm to all the station grids, local colleague Mark Hernandez charaterized the decision on Facebook as "The PNB was strong-armed in LA by a parade of spanish language promoters".  Save KPFA supporter Richard Wolinsky, an unpaid staffer, added "It is my understanding that the spanish language programming mandate is not being enforced". You can see their comments here. The comments indicate the cynicism inherent in voting for something while intending not to enforce it and is reminiscent of the contents of the Margy Wilkinson notebook found in 2015, which divided board colleagues into a list of "us", "them" and "workables" and speculated on how to manipulate the "workables" on the list.

The Berkeley wing of the Siegel/Brazon faction now known as Save KPFA stole the name "Save KPFA" from the 1990's independent listener group that went by that name, changing from a former name of "Concerned Listeners". However "organizational darwinism" works out, it is looking like one ugly process.     1. Hare-brained Haskins set the tone this morning: this last ditch attempt to scam more money out of lingering listeners has summoned the artificial spirit of the cover-before-striking "doctors". Haskins is offering for sale a so-called "documentary" on ongoing "slavery" in the South. The video is several years old and has the look and sound of early cellular—add that to the superficial, dishonest content and you have the perfect "thank you gift" for the choir.

      Then came the wind-up wonder of pan-afrikan pursuit, "dr." and self-proclaimed authority, Daniels, throwing himself—once again—at the feet of a false idol. Geez is putting it mildly.

    Who is the idiot who called Sierra Leone? The station is hemorrhaging money and this guy is calling abroad on WBAI's dime.

    There are 22 PNB members. There are 7 whose terms were extended by one year plus 2 bogus affiliate directors minus three for not seating WBAI directors plus Cerene who was seated separately plus the Siegel/Brazon members elected legitimately equals a rogue majority.

    Oh crap. Another Siegel and a lawyer to boot.

    Is there no money set aside for a NES? I was so looking forward to apply and get disrespected by incompetent GMs and yelled at by people who didn't get their ballots.

    I've listened to some of the Spanish language shows on KPFK. They're scheduled in a single block. There is some items of interest but they raise almost nothing for KPFK and don't cover as much of local news as you would think for a community like LA. Chris, are you familiar with the Spanish language programs on WBAI?

    It somehow made karmic sense to me when I heard the WPFW LES sued after Pacifica took the sensible step of cancelling the election because there were too few candidates.
    Now it looks like some kind of hoax. If there was a lawsuit, we would have heard about it by now.

    1. I don't know who called Sierra Leone, but that's Habte Selassie's show, so he was likely the one. I hope not, however, because Habte is among the stations good guys.

      I am only familiar with WBAI's Spanish language programs in a superficial way, because—to my great regret—I never learned how to speak any form of Spanish. I do, however, have sufficient familiarity with Ebonics to understand the drivel that one hears on some of the station's black shows.

      The whole thing has become a farce, a poorly written SNL skit.

    2. Habte is an old guy, so probably doesn't know how to Skype and such. However, what the Sierra Leone call tells us is how in the dumps WBAI really is that it can't even afford an international call. Twenty-five years ago this would not even be an issue or problem. I really don't believe Habte meant to do anything wrong. At worst, he made a bad judgement.

      The Spanish programming just isn't going to work. The only way to do it is a mixed Spanish/English Con Sabor Latino style, if at all. Driving away your vast majority of non-Spanish speakers to try to find a new audience is a foolish gamble. The very Spanish speakers WBAI would aim at is already being serviced by the ton of Spanish FM pirate radio stations in NYC. Slowly tune around on even any half way decent FM radio any evening and you'll see what I mean, especially in Queens, Bronx or Brooklyn.

      For some reason this year the old Alice Cooper song Elected seems more appropriate than ever. (FYI: This is when Alice Cooper was a band name and not the name of then Vince Furnier, who would change his name to Alice Cooper after the band split up.)

    3. My impression of Habte is that he is a decent man who respects his listeners and has a good grip on the pre-vandalism Pacifica concept.

      As far as I know, it is possible to subscribe to phone service that does not include long distance.

      Let's bear in mind that WBAI is thoroughly disorganized. We hear evidence of this all the time. There don't appear to be any guidelines for handling such things as equipment failure, station breaks, audio balance, and no-show hosts. When they had drawings for "gifts", no rules were announced and if there was a winner, he/she was named willy-nilly, if at all.

      In short, there is nobody on the bridge of this tub.

      This afternoon I heard a 2012 infomercial delivered with characteristic insincerity by Blosdale—it was a sloppy editing job that not only revealed the age but also the origin (KPFK) of this pitch for a bundle of passé crap.

    1. Yes, and that goes with the adoration of a fool like the late Henrik Clark and the regurgitated nonsense of reparations Ron. It's a month-long encore of failures—Kathy was back earlier, trying to sell her eye care—I guess she will offer financial advice again before long.

      They have had more than ample time to prepare a a coordinated fundraiser with fresh material and approach, but Berthold's Bozos can't let go of their swelled ego and he is still in hiding. These are very dumb crooks..

      BTW, on the 4-year-old KPFK infomercial Blosdale spat out today, she had an accented partner who said that pot cures cancer and that it has been medically proven, but "they" don't want people to know.

      This may be the least productive drive yet.

    2. I learned about the late John Henrik Clarke from the Professor aka Reparations Ron. Clarke is a very interesting person. You could do some serious programming around him. I question the choice of a Clarke based premium. I don't think the way to build an audience is by catering to one segment of one community. Having said that, I'll try to keep an open mind. Is there a theme to the fundraiser and if so, how does Clarke fit in?
      I'll take your word Chris about Habte. It says more about the station that such a thing could happen in the first place. I..Oh Crap. Another Siegel and a lawyer to boot.

I was around when Clarke made his move into the spotlight,,, well, not exactly that, but he did take advantage of the black awareness and white guilt that miraculously altered hiring practices. Sometimes it became a door opener for opportunists. My theory is that Clarke saw the door ajar and rushed in. The same thing happened in many cases—Ellis Haizlip's "Soul" being an instance. Most of the people who benefitted from this early byproduct of the burgeoning Civil Rights Movement deserved it, but not all. Of course, given the nature of Clarke's role playing, the moment had a built-in audience... and "Roots" didn't hurt.

    Also, does anyone have a full roster of the names of the six hundred people who where on the balcony with MLK when he was allegedly killed by gunshot? I suspect the James Earl Ray thing was a conspiracy to cover up his having been crushed to death by all those people.

    All the begging they do is bad enough to create "listener fatigue." But when you add to that their overall selling the same shit yet again, year after year, that should really make people run, rather than trot, to the exits.

    Ever wonder WHY the dummies can't come up with more new items? Do producers and distributors know WBAI has a bad reputation for pirating and not paying for items, or are the dummies so dumb and lazy to not look for new crap?

    1. They have been attributing the reversion to something that vaguely suggests a forward-thinking managemen, but someone slipped the truth off their tongue yesterday: they can't afford the.usual number.

      This morning they ran an old infomercial with the wrong number and Reggie apologized for a dead number being giveñ during Prescod's Robeson Package pitch. Listen to that frantic pitch and you will hear her say that she was fortunate to have dug up a few precious copies of this "gift"... A few minutes later, she announced that they were now down to three--somebody's doing a number on Th listeners.

      I wonder how Haskins' cotton picking "documentary" is doing? The producer has a web site dedicated to this cellphone-quality video, which is an obvious scam. The web site contains a trailer and announces that this shocking production is "COMING IN 2010" -- I think WBAI's price is $100. It can be had from the producers for $23 or $25.

  10. I've been listening to Prescod with her Degrue crap premium and having a good laugh. I love the way every few moments of Prescod ranting how some WBAI female voice breaks in with the 516 number and other begging. Makes Prescod sound more like sound bites than an actual show.

    Anyway... I am now suffering from Post Traumatic Lunch Syndrome. My Dominican rice & beef was a bit scarce on the beef today, so I am unsatisfied. Should I go back to the store and demand reparations?

    1. That's what I would do, SDL. I heard about half an hour of Prescod having a hysterical slave after-effect, and that WBAI woman sounded like stuck 78.

      All this crap by Joy the Gruesome made me think back to my childhood in Iceland. Was I suffering from Pst Traumatic Barbarism Syndrome? Of course, I could also have had a touch of the Post Traumatic Edda Syndrome, the one that sometimes leads to writer's cramp and/or block.

      Have you noticed how Prescod has reasoned, calm moments from time to time—it is when they start begging that the become frenetic. I loved how she looked back at her daughter's childhood and kicked herself for not having known about the possibility of PTSS... things could have been so different.

      These are out and out idiots and/or charlatans.

  14. In all fairness, we should point out that WBAI also does not talk about James Chaney, the black victim in this Philadelphia (MS) murder. Is the station's leitmotif racism? Yes, but not one borne entirely out of ethnic bias. You have a station occupied and dominated by people who have little or nothing to offer an enlightened, thinking listenership.

    The irony is that WBAI's misfits foment the very racism they claim to be fighting. It's about mob mentality blossoming on a vandalized radio station few people care about anymore. It's about a suicide of sorts: a micro Masada, if you will. It's about attracting attention and not having to rant to passerbys on a street corner.

    WBAI should neither be black nor Jewish—ethic origin ought always t take a back seat to intelligence and vision. What idiots yelled on Eastern Parkway is par for the course—all fanatics resort to this sort of thing.

    Finally, you are right not to blame WBAI, per se, it is only the conduit for such anti-social behavior, as well as for positive expression. The latter is but a flicker these days.

  15. Nobody can deny the tie that existed between African-Americans and Jews during the pivotal Civil Rights Movement. WBAI gave the events, its participants and background extensive and fair coverage. That was not something we sat down and planned, it was just the way we operated at a time when we touted and practiced free speech. The racism we hear on today's WBAI goes against the grain Lew Hlll sowed and, sad to say, it has emanated from both sides of the ethnic fence over the years.

  16. Morris Dees is a good man. He is Jewish too. Blacks and Jews have worked closely for a good purpose, however, Jews use their religion to get over and to damage the society through genital mutilation of boys. It was a sneaky way of introducing circumcision to the society. It has caused lasting harm to society. I heard many programs on WBAI over the years on circumcision - don't know who did them, but they were informative.

    Doing good inevitably sparks the kind of hatred these societal misfits spew. Remember the lies they came up with to stop John Kerry? They even formed a bogus group called "Swift Boat Veterans for Truth." Shades of that sort of thing can be found all over the place at today's WBAI.

  18. Some years back the Village Voice newspaper had an expose of the SPLC sending out donation request mailings with higher suggested amounts on the enclosed literature to people with Jewish names than to people with non-Jewish names.

    5. Well, numbers can't be reliably counted, but they are no doubt in the millions, almost being a sport. What we can see is that the entirety of Native American culture, nations, traditions, were destroyed. The destruction of the Native Americans in the USA was certainly one of the - if not the - most thorough destructions of a people or peoples in history. And if we look at the present, the destruction continues. Too bad WBAI has jerks like Kane or Ghosthorse instead of real intelligent activists on the air to represent this tragedy.

    1. It must be dawning on them, the reparations momentum Ron Daniels is trying to fuel seems to have been deflated somewhat. The activity, if one can call it that, appears to be coming from one of those Jamaican "knights"—shades of vintage scammer Garvey. In fact, Daniels' hyperbolical rants strike me as having been scripted in the islands.

      Apropos irony, I find it amusing—in a pathetic sort of way—that the bigoted BAI bozos profess to be fighting for equality, determined to combat racism. Yet all they do is fuel the kind of crap Trump preaches.

      The fact that their racist attitude has scared of rather than attracted listeners should have told them something, but a rag doll in the front office would be as useful as Reimers is and we are talking bout a crew that has no vision or creativity. They are not slow learners, they are no learners. If you listen to Haskins on any given day, he will make it abundantly clear that three decades + at WBAI has taught him noting. Listen to his inability to maintain a reasonably uniform volume, for example. He can't, and that is basic.

  25. SPLC used to distribute a biography of Morris Dees. (That is called a premium for all of you used to the illegally ripped CDs from WBAI) There is a story in his early life where he helped collect debts for some local businessman. Instead of waiting to be billed, the businessman gave him a token amount as if he was rewarding a child for running an errand. Dees ripped up the check. His father who was a farmer was livid and told his son you don't act that way towards people like that businessman. Dees stood firm. He just wasn't going to accept that kind of treatment. I remember that about him because he could easily have led a comfortable life as a lawyer but he chose to go in another direction.
